[SPEAKER_01]: The morning of March 16th, 2012, began like any other.

[SPEAKER_01]: Sierra was born in Fremont, California, on October 19th, 1996.

[SPEAKER_01]: She had recently moved to the Morgan Hill area, living with her mother after her parents divorced.

[SPEAKER_01]: After she left, Sierra's mother Marlene sent her daughter a few text messages, reminding her about the chores as she was supposed to do when she came home from school that day.

[SPEAKER_01]: Thinking that Sierra was just busy with schoolwork.

[SPEAKER_01]: Marlene wrapped up her work day at about 345 that afternoon, but she still hadn't received a response from Sierra.

[SPEAKER_01]: At this point, Marlene was starting to worry, and that worry only grew when she arrived home to find the house empty.

[SPEAKER_01]: And when she arrived, she was shocked to learn that Sierra had never made it to class.

[SPEAKER_01]: Marlene was scared and concerned for Sierra's safety, so she called the police and reported the teenager missing.

[SPEAKER_01]: Now, investigators originally classified Sierra as a missing person, however, they didn't initially suspect any file play, but they still proceeded with the investigation, checking the footage from the school bus.

[SPEAKER_01]: leading investigators to believe that something may have happened between home and the bus stop.

[SPEAKER_01]: So they began searching around the area, and the following day on March 17th, Officer's Founty Air was phone lying in an intersection in Morgan Hill about two miles from Sierra's home.

[SPEAKER_01]: Surprisingly, the phone was intact, and it appeared that it may have been thrown from a vehicle.

[SPEAKER_01]: But sadly, the device didn't lead to any clues as to where Sierra may be, so they continued searching.

[SPEAKER_01]: Only two intersections away lying on the side of the road near a shed was Sierra's pink juicy brand bag.

[SPEAKER_01]: Inside was a folded set of clothing, including a pair of jeans and a San Jose Sharks T-shirt.

[SPEAKER_01]: So the bag in the clothing were sent to the crime lab for DNA testing.

[SPEAKER_01]: In fact, this search was actually organized by the Clause Kids Foundation, an organization created by Mark Clause after his daughter Polly was abducted from sleepover and murdered.

[SPEAKER_01]: being charged with loot and lascivious acts with a girl under the age of 14 in 2007.

[SPEAKER_01]: He would be found guilty and served eight months in the Alameda County prison, and having to register as a sex offender upon his release.

[SPEAKER_01]: Stephen claimed that he was innocent, and he told police that he had pleaded guilty to the previous charge based on some bad legal advice, and that he had absolutely nothing to do with his daughter's disappearance.

[SPEAKER_01]: Investigators looked into Stephen and his activity on the day that his daughter went missing and were able to ultimately rule him out as a suspect.

[SPEAKER_01]: Additionally, there was nothing else in Sierra's home life that raised any red flags or indicated that she would voluntarily run away.

[SPEAKER_01]: So authorities began looking at every registered sex offender in the area, hoping to account for their whereabouts on the day that Sierra went missing.

[SPEAKER_01]: DNA testing had been completed on the clothing that investigators found and a trace sample linked back to a man in the area.

[SPEAKER_01]: Garcia Torres's DNA was already in the law enforcement database from a previous crime.

[SPEAKER_01]: He drove a red Volkswagen Jetta and worked at a safeway grocery store nearby, living in an RV park with his pregnant girlfriend and mother, only seven miles from Sierra's bus stop.

[SPEAKER_01]: So detectives placed Garcia Torres under 24-hour surveillance, and they began taking a closer look at his activity on the day that Sierra went missing.

[SPEAKER_01]: And in the video, GarcÃa Torres could be seen leaving in his jetta just 15 minutes before Sierra would have left her home.

[SPEAKER_01]: And when asked where he was headed that morning, he told investigators that he had gone on a solo fishing trip, with no witnesses to corroborate a story.

[SPEAKER_01]: And when pressed about his DNA being found on Sierra's belongings, Garcia Torres offered a bizarre and unsettling theory.

[SPEAKER_01]: He told investigators that he enjoyed masturbating in his car, keeping a role of toilet paper or tissues to clean up before discarding them out the window.

[SPEAKER_01]: Garcia Torres suggested that one of the soil tissues could have landed on Sierra's bag, obviously explaining why his DNA was found on her belongings.

[SPEAKER_01]: Additionally, witnesses told police that they saw a red jetter near the bus stop on the day that Sierra went missing.

[SPEAKER_01]: So on April 7th, detectives obtained a warrant and seize the vehicle, and when conducting their search, there was some damning evidence found.

[SPEAKER_01]: Those hairs would be tested and would be found to belong to Sierra.

[SPEAKER_01]: This was the evidence that authorities needed, and on May 21st, 2012, and Tulan Garcia Torres was arrested and charged with a kidnapping and murder of Sierra Lamar.

[SPEAKER_01]: But now the trial would begin in January of 2017, during which another bombshell was dropped.

[SPEAKER_01]: And toll in Garcia Torres pleaded not guilty, but it was revealed that he was involved in a series of attempted kidnappings in 2009, for which he was also charged.

[SPEAKER_01]: The women who were victimized told police that they had been attacked in the parking lots of Morgan Hills area safeway grocery stores.

[SPEAKER_01]: The women told police that a man had approached them at night, either as they were entering their vehicles or preparing to drive away.

[SPEAKER_01]: And in one of these cases, the man used the stun gun to subdue one of the women, entering her vehicle through the back door.

[SPEAKER_01]: Now luckily, in each attack, the women's screams scared the man off.

[SPEAKER_01]: Now Prince were pulled from the nine-volt battery inside, and they were a match to Anthol in Garcia Torres.

[SPEAKER_01]: that a fence argued that even if Sierra had been in his vehicle, that didn't mean there was enough evidence to convict GarcÃa Torres of her murder.

[SPEAKER_01]: On May 4th, 2017, the jury began deliberations, and only four days later, they announced that they had reached a verdict.

[SPEAKER_01]: Antholen, Garcia Torres, was found guilty of all counts and sentenced to life in prison, and it seemed that for now justice had been served.

[SPEAKER_01]: But Garcia Torres refused to provide the location of Sierra's body, and this prevented the family from ever having a funeral for the 15-year-old.

[SPEAKER_01]: But to Sierra's family, it was a punch in the gut, and they're hoping that this decision is overturned by the California Supreme Court.

[SPEAKER_01]: And then to think that, you know, this massive search was not only done but organized by the organization that was started by poly classes family, you know, to know that, you know, again, another little girl was abducted and murdered and taken from her family and it, this is the one aspect of this case that I think.

[SPEAKER_01]: actually made my heart feel a little bit warmer because again in these kind of circumstances I know I've talked about this before but I just feel like it would be so easy to shut down and shut out the world and kind of give up you know something like this where to happen to your child and so to know that the classes were out there and they started this organization to help others who have gone through something similar to what they've gone through

[SPEAKER_01]: to me it is very obvious that this was the right person and I know that our judicial system has to work in the way that it has to work and there are reasons why convictions get overturned and we have to do our best to make sure that if somebody is being sentenced for something like this that it's done correctly and the evidence is there and there aren't those missteps.
